The following describes how Rachel Altschuler (“The Company”) uses and disseminates information you provide through www.RachelAltschuler.com and its sub-domains and affiliated sites, as well as Rachel Altschuler pages and accounts on Twitter®, Facebook®, LinkedIn®, Instagram®, TikTok®, Clubhouse® and YouTube® (the “Sites). INFORMATION WE COLLECT

We may collect several types of information from and about you when you visit the Site. This includes Personal information which is information that can be used to personally identify you, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline.  We may also collect Non-Personal Information that cannot be used to personally identify you.  This includes anonymous usage data, information about your internet connection, equipment you use to access the Site, platform types, what websites or search terms referred you to the Site, preferences you submit, preferences that are generated based on the data you submit, referring/exit pages, and date/time stamps.

We collection Personal Information when you complete forms on the Site or through correspondence including email address if you contact us. Some services, such as email opt-ins may require you to provide Personal Data. In such a cases where personal information is requested, you may choose not to provide its, but in that case it may not be possible for you to gain access to certain parts of the site or content.   

When you buy something on this website, we may collect personal information from you to fulfill the order. We may collect information such as:

  • Billing and shipping address

  • Details relating to your purchase (for example, your shirt size if applicable)

  • Email address

  • Name

  • Phone number

We share this information with Squarespace, our online store hosting provider, so that they can provide website services to us.

As you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience.

We collect Non-Personal Information from you via the use of automatic data collection technologies including:

  • Cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of the Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site.

Pages of the Site and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) are files used to record information about how users browse the Site (for example, recording the popularity of certain website content).


Though information we collect automatically is only statistical data and does not include personal information, we may maintain it or associate it with personal information we collect in other ways or receive from third parties. This helps us to improve the Site and deliver a better and more personalized experience for users of the Site.

INTERNATIONAL PRIVACY LAWS

If you are visiting the Site from outside the United States, please be aware that you are sending information to the United States where my servers are located. Information you submit may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by me. These countries (including the United States) may not necessarily have the same data protection laws as as your country of residence; however, the collection, storage, and use of your data on the Site will at all times continue to be governed by this Privacy Policy. 

MINORS

The Sites are not intended for individuals under the age of 18. If you are under 18, you may only use the Sites under the supervision of a parent or guardian. The Company does not collect or maintain information from anyone known to be under the age of 18, and no part of this website is designed to attract anyone under the age of 18. No products or services are intended for purchase by children. If  it is discovered any such information has been received from a child in violation of this policy, that information will be deleted.

DATA RETENTION

Personal Data collected from Users is retained for as long as the User’s account is active or otherwise for a limited period of time as long as needed to fulfill the purposes for which the information was initially collected or unless otherwise required by law. I will retain and use information as necessary to comply with my legal obligations, resolve disputes, and enforce my agreements for a period of number of years 

USE OF YOUR PERSONAL INFORMATION

We use information that we collect about you or that you provide to us, including any personal information:

  • To present the Site and its contents to you.

  • To provide you with information, products, or services that you request from us.

  • To fulfill any other purpose for which you provide it.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To notify you about changes to the Site or any products or services offered or provided through it.

  • In any other way we may describe when you provide the information.

  • For any other purpose with your consent.

You are responsible for reviewing the privacy statements and policies of other websites you choose to link to or from the Sites, so that you may understand how those sites collect, use and store your information. I am not responsible for the privacy statements, policies or content of any other websites. Websites containing co-branding (referencing my name and a third party’s name) contain content delivered by the third party and not me. 

We may disclose aggregated, Non-Personal Information about users of the Site without restriction.

In general, the Company does not sell, trade or otherwise share your Personal Information with third parties without your consent.  We may share your Personal Information with subsidiaries and affiliates of the Company, to our vendors and third-party providers only to the extent necessary to allow them to perform the services they provide for the Company.  Certain third-party service providers, such as payment processors, have their own privacy policies with respect to the information that we are required to provide to them in order to use their services.  For these third-party service providers, we recommend that you read their privacy policies to understand the manner in which your Personal Information will be handled by such providers.

Additionally, we may disclose personal information about you to comply with a court order, law, or legal process, or enforce our Terms of Use.

SQUARESPACE

The Site is hosted by Squarespace.  Squarespace provides us with the platform on which the Site is built.  Your information, including Personal Information, may be stored through Squarespace’s servers.  By visiting the Site, you consent to Squarespace’s collection, disclosure, storage, and use of your Personal Information in accordance with Squarespace's privacy policy available at https://www.squarespace.com/privacy.   

MERGER OR ACQUISITION

In the event the Company or Squarespace undergo a business transaction such as a divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of The Company, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of ours or Squarespace’s assets may continue to process your Personal Information as set forth in this Privacy Policy. If our information practices change at any time in the future, we will post the policy changes here so that you may opt out of the new information practices. 

LINKS TO OTHER WEBSITES

The Site may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link via our Site. To the extent that you access or use the Site through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage you to read the privacy statements of other websites before proceeding to use them. 

LIMITATIONS

By using the Sites you agree that I am not responsible for: (i) any disclosure of your personal information made by you to a third party through your use of the Sites; (ii) any disclosure of your personal information obtained illegally from me; or (iii) any accidental disclosure of your personal information made by me.

This Privacy Policy may be updated from time to time. Any modifications will be effective immediately when they are posted. You are responsible for reviewing any modified terms by visiting this page. When this Policy is updated, the date of revisions will be noted at the top of the page. Your continued use of a Site following any changes means you accept and agree to any changes.

 This Privacy Notice explains, in general, the procedures behind our collection, storage, and process of the information we may collect from you online, if any. This notice is intended to operate as a supplement to our Privacy Policy, for the sole purpose of defining rights that California consumers may have with respect to our Sites under the California Consumer Privacy Act of 2018 (“CCPA”).

Terms such as “personal information” and “processing” that are defined in the CCPA will have the same definitions in this Notice as we understand them to have under the CCPA. This includes exceptions to certain terms under the CCPA. For example, “personal information” under the CCPA does not include publicly available, aggregate consumer information, or de-identified, information.

Written responses to information requested under this section will be delivered by mail or electronically. If a request is declined, we will provide an explanation as to why.  We will not discriminate against you for exercising any rights available to you under applicable law.

We additionally reserve the right to modify, or delete some or all of your information collected. In such a case, we will retain data as reasonably necessary to comply with any legal obligations, including regulatory, security, or dispute requirements, law enforcement requirements, to prevent fraud or abuse, or to enforce obligations, including any other requests from you.

You can designate an agent to make a request on your behalf in one of two ways: (1) having your agent send us a letter, signed by you, certifying that the agent is acting on your behalf and showing proof that they are registered with the California Secretary of State; or (2) by you and the agent executing and sending us a notarized power of attorney stating that the agent is authorized to act on your behalf.
